Terms of service

Effective: October 16, 2026

These terms are an agreement between you and CapitalSites ("CapitalSites," "we," "us") of Tallahassee, Florida. They apply when you use capitalsites.net, request a consultation, or buy any of our services. If you are buying for a business, you confirm you can agree to these terms on its behalf. Please also read our privacy policy.

1. Our services

We design, build, host and maintain websites for local businesses. Depending on your plan, we also provide AI lead response, missed-call text back, booking and follow-ups, social media setup, and local search setup. What each plan includes is listed on our pricing section at the time you sign up and in your client portal.

2. Getting started

After a free consultation we send you a secure checkout link. Your account and client portal are activated only after payment is confirmed by our payment processor, Stripe. You agree to keep your account details accurate and your sign-in links private, and you are responsible for activity in your account.

3. Your content and approvals

You provide the information and materials we need, such as business details, hours, prices, photos and logos, through your client portal. You confirm that this content is accurate and that you have the right to use it, including permission from anyone shown in photos. We publish only what you approve.

Timelines we give (for example, "live in 2–3 weeks") are estimates and depend on receiving your content and approvals.

4. Design, revisions and launch

You choose from design concepts we prepare, and one round of changes is included. Additional rounds or new work outside your plan are quoted first and only done after you agree. Your site launches after you approve the final design and our launch checks pass. If you change published business details later, we may ask you to approve the updated design again.

5. Fees, billing and taxes

Plans are billed monthly in advance through Stripe and renew automatically until cancelled. Prices are in US dollars and do not include taxes, which are added where required. We will tell you before any price change takes effect, and a change applies from your next billing period.

If a payment fails, we will notify you and Stripe will retry the charge. While a payment is overdue we may pause optional automations (such as texting or scheduled posts) after notice. Your website stays online whenever we can reasonably keep it up. If an account remains unpaid, we may end the service under section 7.

6. Cancellation and refunds

Plans are month-to-month with no long-term contract. You can cancel at any time from your client portal or by emailing us. Cancellation takes effect at the end of your current paid period, and service continues until then. Payments already made are not refunded, except where required by law or where we choose to issue a credit.

7. When service ends

When service ends for any reason:

  • You can download an export of your business details, uploaded files, website files and form messages for a limited time.
  • We will help you move your domain and point it to a new host.
  • If we provided a phone number, we will cooperate with a transfer (port-out) to your new provider.
  • We stop texting, scheduled posts and other automations and remove our access to your connected accounts.
  • We then delete your files and personal data we are not required to keep. We keep records we must retain, such as billing, legal and opt-out records.

We may suspend or end the service if you materially break these terms, use the services unlawfully, or leave an account unpaid, after giving notice where reasonable.

8. Ownership

Your domain, business content, photos, logos and data belong to you. When your account is paid in full, you may keep and use the website files we delivered for your business, including after you cancel. We keep ownership of our own tools, templates, software and know-how, and of any third-party components, which remain under their own licenses. We may show your launched site in our portfolio unless you ask us not to.

9. Third-party services

Our services rely on providers such as Stripe (payments), our hosting provider, domain registrars, Twilio and the phone carriers (calls and texts), scheduling and messaging tools, AI model providers, Google, and social media platforms. Their own terms apply to your use of them, and we are not responsible for their outages, decisions or policy changes. Where possible, accounts such as your domain, Google Business Profile and social media pages stay in your name, and you grant us access instead of sharing passwords.

10. Texting, calls and AI features

Business texting must be approved by the phone carriers before it can be turned on, which can take days to weeks. We keep texting off until approval and testing are complete. Calls handled through our service are not recorded.

You are responsible for using texting and AI features lawfully. That includes having any consent your customers must give and honoring opt-outs, which our systems process automatically when someone replies STOP. AI replies are generated from the business information you approve, but they can make mistakes. Review your conversations, and do not rely on the AI for emergencies or for medical, legal or financial advice.

11. Acceptable use

You may not use our services to break any law, send spam or unwanted messages, infringe anyone's rights, publish harmful or misleading content, interfere with our systems, or try to access other customers' data.

12. No guaranteed results

We work hard to bring you more leads and customers, but we do not guarantee specific results, such as search rankings, reviews, traffic, calls, leads or revenue. Reports we provide show only data we actually measure.

13. Disclaimers

Except as stated in these terms, our services are provided "as is" and "as available." To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the services will be uninterrupted or error-free, but we will work to fix problems promptly.

14. Limitation of liability

To the extent the law allows, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits or data. Our total liability for any claim is limited to the amount you paid us in the three months before the claim arose. These limits do not apply where the law does not allow them.

15. Indemnity

You agree to defend and hold us harmless from third-party claims arising from content you provide or from your use of the services in breach of these terms or the law.

16. Changes to these terms

We may update these terms from time to time. We will post the new version here with a new effective date and, for material changes, notify active clients by email at least 30 days before they apply.

17. Governing law

These terms are governed by the laws of the State of Florida. Any dispute will be handled in the state or federal courts located in Leon County, Florida, unless the law requires otherwise. If any part of these terms is found unenforceable, the rest stays in effect. These terms, together with any written quote or order for your plan, are the entire agreement between us.
